1. Who you are dealing with

This website, modavenpteltd.store, and the Modaven brand are operated by JENNIFER ANN CHAGOLLA FUNY LLC, a single-member limited liability company registered in the State of Arizona, with a mailing address at 17425 N 19th Ave, Apt 2206, Phoenix, AZ 85023, United States. In these terms, “we,” “us,” and “Modaven” mean that company. “You” means the person using the site or placing an order.

By browsing this site or placing an order, you agree to these terms. If you do not agree with them, please do not use the site.

2. Eligibility

You must be at least 18 years old, or the age of majority in your state, to place an order. By ordering you confirm that you meet that requirement and that the payment method you use belongs to you or that you have permission to use it.

We sell to customers in the United States only. Orders cannot be placed for delivery outside the United States.

3. Our products are made to order

Every shirt sold here is printed after you order it. We do not hold finished stock. This has three consequences you should understand before buying.

Production takes 2-3 business days before anything ships.
Once a shirt enters production it cannot be cancelled, because it cannot be sold to anyone else.
Each garment is dyed as a finished shirt, so color varies between production batches and will not match a screen swatch exactly.

The blank garments are Comfort Colors® 1717 shirts manufactured in Honduras. Printing takes place in the United States. Comfort Colors is a trademark of its owner and is named here to identify the blank we print on; we are not affiliated with or endorsed by that company.

4. Product descriptions and images

We describe our products as accurately as we can, including the specific size and color ranges actually available for each design. Photographs are of the real product. Even so, screens render color differently, and garment-dyed cotton varies from batch to batch, so the shirt you receive may differ slightly in shade from the image you saw.

Measurements are given as guidance. Cut-and-sew garments carry normal manufacturing tolerance.

5. Pricing and pricing errors

All prices are in U.S. dollars. Prices shown on product pages include any applicable U.S. sales tax; shipping is calculated and displayed separately before you pay. We do not add fees after checkout.

We may change prices at any time. The price that applies to your order is the price displayed when you place it.

Occasionally a product may be listed at an incorrect price because of a human or system error. If that happens, we are not obliged to sell at the wrong price. We will contact you before charging you, and you may either confirm the order at the correct price or cancel it for a full refund.

6. When an order becomes a contract

Placing an order is an offer to buy. The order confirmation email is an acknowledgement that we received your offer, not an acceptance of it. A contract is formed only when we send the shipping notification for that order.

We may decline or cancel an order before shipment, including where the item was mispriced, where we cannot verify the billing or shipping details, where the order appears fraudulent, or where the shipping address cannot be served. If we cancel, you are refunded in full.

7. Payment

Payment is taken at checkout through third-party payment providers. We do not receive or store your full card number. Details are set out in our Payment Policy.

8. Shipping and risk of loss

Shipping times, rates, and our handling of lost or stolen packages are set out in the Shipping Policy, which forms part of these terms. Risk of loss stays with us until the package reaches the delivery address; if a package is confirmed lost, we reprint or refund at your choice.

9. Returns

Our Refund & Returns Policy forms part of these terms. In summary: 30 days from delivery, unworn and unwashed with tags intact, no restocking fee, we pay return shipping when the fault is ours and you pay it when it is not.

10. Intellectual property

The designs printed on our shirts, along with the site's text, photographs, and layout, are owned by us or used with permission. You may not reproduce, distribute, or create derivative works from them for commercial purposes without our written consent. Buying a shirt gives you the shirt, not a license to the artwork on it.

11. Customer reviews

If and when we publish customer reviews, they will follow the Federal Trade Commission's Rule on the Use of Consumer Reviews and Testimonials. Specifically: we will not write reviews ourselves or have them written on our behalf, we will not buy or incentivize positive reviews, we will not suppress negative reviews that are genuine, and we will not present reviews from unrelated products as if they were about ours.

As of the effective date of these terms, Modaven has published no customer reviews, because we have not yet earned any. Any review section that appears in future will be built from real verified orders.

12. Acceptable use

Do not use this site to break the law, to attempt unauthorized access to our systems or accounts, to scrape content at a rate that degrades the service, to submit false orders, or to upload anything malicious. We may suspend access where we reasonably believe any of that is happening.

13. Third-party links

The site may link to services we do not control, such as payment providers or carrier tracking pages. We are not responsible for their content or their practices, and their own terms and privacy policies apply when you use them.

14. Disclaimer of warranties

Except where the law says otherwise, the site and its content are provided “as is.” We do not warrant that the site will be uninterrupted or error-free. This does not affect any warranty that applies to the goods themselves under your state's law.

15. Limitation of liability

To the extent permitted by law, our total liability arising out of any order is limited to the amount you paid for that order. We are not liable for indirect or consequential losses.

Some states do not allow the exclusion or limitation of certain damages. Where your state does not allow it, these limits do not apply to you.

16. Indemnity

You agree to cover our reasonable costs if a third party brings a claim against us because you used the site in breach of these terms or in breach of the law.

17. Copyright complaints

If you believe material on this site infringes your copyright, email support@modavenpteltd.store with: your contact details, identification of the work you say is infringed, the URL of the material in question, a statement that you believe in good faith the use is not authorized, a statement that your notice is accurate and that you are the rights holder or authorized to act for them, and your physical or electronic signature. We will investigate and remove infringing material where a valid notice is received.

18. Governing law and disputes

These terms are governed by the laws of the State of Arizona, without regard to its conflict-of-laws rules.

If something goes wrong, email us first. Most problems are resolved that way within a day or two. If a dispute cannot be resolved informally, it may be brought in the state or federal courts of Maricopa County, Arizona — but you may also bring a claim in the courts of the state where you live, and nothing here prevents you from bringing a claim in small claims court.

Your rights as a consumer are not affected by this section. Nothing in these terms waives any right you have under the consumer protection laws of your state, and nothing here limits the authority of the Federal Trade Commission or your state Attorney General.

19. Changes to these terms

We may update these terms as the business changes or as the law changes. The version in force for your order is the version published when you placed it. We update the effective date at the top of this page whenever we make a change.
